The Court of Appeals has ordered the National Telecommunications Commision (NTC) to comment on the petition to stop the bidding and awarding of the new 3rd Telco player.
In a 2-page resolution of the CA Special 12th Division, Ricardo Rosario, concurred by Justices Eduardo Peralta and Ma. Luisa Quijano-Padilla last Nov. 16, the NTC is asked to comment or oppose the petition filed by an unnamed telco firm.
“Without necessarily giving due course to the instant petition for certiorari, the National Telecommunications Commission is directed to file its comment/opposition on the petition and on petitioner’s prayer for injunctive relief, within 10 days from notice,” – Court of Appeals
The petitioner may file a reply within five days after the receipt of NTC’s comment.
A petition to cease bidding was also previously filed by NOW Telecom, but the apallete court did not issue a temporary restraining order afterwards.
